General Terms and Conditions of Sale

Scope

These General Terms and Conditions of Sale (hereinafter referred to as “GTC”), must apply to all commercial relations between Déniel Choux etc  – Feldstrasse 47 – 8902 Urdorf – Switzerland (hereinafter referred to as “Choux etc”) and its customers, that is to say legal or natural persons.

Placing an Order

The customer can request a quote via the website www.choux-etc.ch or by email at hello@choux-etc.ch, at least 3 days before the delivery date.

Any proposal for a quote made by Choux etc, followed by the order confirmation by the customer has the value of a legal contract and therefore implies acceptance without restriction or reservation to the following General Terms and Conditions of sale.

At the time of acceptance of the quote, the customer is requested to warn Choux etc of any food hyper sensibility (allergies or intolerances) for example.

Terms of Delivery

Delivery is made by Choux etc in the areas served. These areas can be checked by the customer directly on the order page by entering their postal code. Delivery costs may vary, in particular depending on the distance and any specific packaging necessary to transport the products. They are indicated separately to the customer for information when finalizing the order. The delivery is invoiced to the customer, the costs incurred being indicated in the details of the quote and the final invoice.

The customer indicates when requesting a quote, a preference for a desired date and time slot (lasting one hour). If the slot is finally unavailable, Choux etc will suggest another date / time that the client will be free to refuse. If the customer is unable to arrive at the delivery point at the time defined with Choux etc, he must notify Choux etc as soon as possible, at least one hour before the start of the defined time slot. . If Choux etc is available for another delivery slot at the same address and within the time slots offered on the website, the amount of the invoice will not be modified. If the address is changed, the amount of delivery costs will be recalculated according to the prices defined on the website. If the time slot is not one of those proposed, an additional fee of CHF 20.- will be applied. If a delivery solution cannot be found, the cancellation conditions will apply.

Terms of Cancelation

The customer can cancel their order free of charge up to 48 hours before the scheduled delivery date and time.

Any validation of the quote becomes irrevocable 48 hours before the scheduled delivery, since the specific purchases to the order will have been made.

If the cancellation of the order takes place between 48 hours and 24 hours before the scheduled delivery date and time, the customer agrees to pay 30% of the total amount of the invoice, excluding delivery costs.

If the cancellation of the order takes place less than 24 hours before the scheduled delivery date and time, the customer agrees to pay the full amount of the invoice, excluding delivery costs.

Rates and Terms of Payment

All the prices of the products indicated are gross prices (including value added tax / VAT) excluding delivery costs and specific packaging. Choux etc endeavours to ensure that the prices and information on choux-etc.ch are correct. However, update errors cannot be excluded. Thus, all information on products, services and prices are provided without warranty and should not be construed as insurance. Only the information provided on the quote received by the customer is firm and final with regard to the services provided.

The minimum purchase amount per order, excluding delivery costs, is CHF 10.-.

The invoice is due upon issue. It is delivered on the day of delivery by email. The customer undertakes to settle the invoice using the payment options provided at the latest within 30 net days of receipt.

Failure to pay

After expiration of the payment period of 30 days net, the customer is automatically in default of payment. Choux etc is entitled to collect additional recall costs of up to CHF 30.- per recall. The amount of the unpaid invoice, plus reminder costs and interest, can be transferred or assigned to a collection agency. In addition, in the event of any delay in payment, the customer is required to reimburse all of the costs incurred by Choux etc or by a collection agency.

Product Availability

Choux etc strives to work with fresh, organic, local and seasonal produce. Thus, Choux etc reserve the right to make changes to the diversity of the online store at any time, given the seasonality and availability of these fresh products used.

Product Visual

Choux etc works handcrafted and with fresh products, the products produced may differ visually from those presented on the website. The photographs presenting the products are only a suggestion of presentation.

Guarantee and Responsibility

The customer accepts that the responsibility for Choux etc is not engaged in case of force majeure.

Choux etc being handcrafted, episodes of strikes, illness, unforeseeable failures in the means of transport or equipment can prevent the production or delivery of orders. The client takes note of this possibility. Choux etc agrees to reimburse the customer for the amount advanced to Choux etc if such a situation should arise.

Data protection

Choux etc uses the data collected during the order only as part of the order process (name, billing address, e-mail, delivery address …) as well as for customer follow-up. This data will in no case be passed on to third parties.

Choux-etc.ch is hosted by WordPress and cannot prevent the use of navigation data for operational purposes. No responsibility is assumed for the security of the navigation data transmitted.

Intellectual property

All elements of the www.choux-etc.ch website are protected by copyright, trademarks or patents and more generally by intellectual property. They are the exclusive property of Choux etc. Information, photographs, logos, drawings, brands, models, slogans, layout, graphic corporate design and in general, advertisements and their content, etc. accessible through the website are protected by intellectual and / or industrial property law. Unless expressly authorized for this purpose by Choux etc and / or the third party concerned, the user is not authorized to use, modify, reproduce, rent, borrow, sell, distribute or create derivative works based in whole or in part on the elements present on the website. It is therefore prohibited (and the user may not grant permission to others) to copy, modify, create a derivative work, reverse the design or assembly or in any other way attempt to find the source code, sell, assign, sub-license or otherwise transfer any rights in the website and its content. The user who has a personal website and who wishes to place, for personal use, on his site a simple link direct to the home page of the Choux etc website must obligatorily request authorization from Choux etc. In this case, it will not be an implicit affiliation agreement. On the other hand, any hypertext link referring to the site of Choux etc and using the technique of framing or in-line linking is strictly prohibited. In all cases, any link, even tacitly authorized, must be removed at the request of Choux etc. They are the exclusive property of  Choux etc.

Place of Jurisdiction

In the event of disputes arising directly or indirectly from the contractual relationship between  Choux etc  and the client, the competent jurisdiction is the Canton of  Zürich (CH). The legal relationship is subject to Swiss law. The legal relationship is subject to Swiss law.
